Colorado Springs father sentenced for arson deaths of 3 children

COLORADO SPRINGS – The father of three Colorado Springs children killed in a house fire was sentenced Thursday to three consecutive life terms in prison without the possibility of parole.

Fourth Judicial District Judge David Miller also sentenced Timothy Nicholls to 72 years for child abuse resulting in death, and 9 years for arson, attempted theft, cruelty to animals, possession of a controlled substance and use of a controlled substance.

The judge ordered Nicholls to serve the 72 years concurrent with his life sentences, and 9 years consecutive to his life terms.

Nicholls, 36, was convicted earlier this month of starting a March 7, 2003 fire that killed his children, Sophia, 5, and Sierra, 3, and his stepson, Jay, 11.

Sierra would have turned 8 on Thursday.

“You walked by them,” Miller said, addressing Nicholls, in court. “You walked by them, and you got out of the house. Then you watched the house and your children _ you watched your very soul go up in smoke.”

Arson investigators found traces of an accelerant on the children’s pajamas, and a nearly empty can of highly flammable cleaning solvent under bushes outside the burned home.

Prosecutors claimed Nicholls started the blaze to collect insurance money to pay off drug debts.

Nicholls’ wife, Deborah, was not charged in the death of the children, but was expected to stand trial for allegedly filing a fraudulent insurance claim and possession of drugs.

COLORADO SPRINGS, Colo. (KKTV) - Crews were called to a house fire Thursday evening.

At about 4:30 p.m. the Colorado Springs Fire Department was dispatched to 2930 Del Ray Plaza. The neighborhood is near Vickers Drive and N. Union Boulevard.

The fire was in the attic of the home and firefighters were able to quickly extinguish it. Fire crews say it started from a lightning strike from the storms that were moving through the area.

“This was a neighbor that called it in, a neighbor came over and knocked on the door, and actually let her know that she had smoke and fire at the top of her house. She didn’t know,” Captain Mike Smaldino said.

Firefighters warn that it isn’t uncommon for fires to start from lightning strikes. Crews say the neighbor did everything right and likely saved the homeowner’s life and home.

They also want people to be aware during storms and make sure they watch the location where lightning strikes to make sure a fire doesn’t start from it.
