Albertsons sues Boise bakery, cites illegal competition

BOISE, Idaho — UPDATE, 9:42 a.m. on Aug. 7: KTVB added more details from the lease agreement to the story below. We are still waiting for a response from Albertsons. 

Albertsons is suing a small, family-owned bakery located in the same plaza off Overland Road and Orchard Street as one of the Boise-based grocer's stores.

According to court documents, Albertsons alleges that Granny C's Bakery is competing against them, something that the lease agreement Granny C’s Bakery signed prevents them from doing.

"They just want us out and so that may be where we go," said Brad Deboer, the owner of Granny C's Bakery.

Granny C's Bakery opened just three months ago.

Several days ago, they were served with a lawsuit from Albertsons.

"They say that we’re using a space in this development that is not allowed to be used as a bakery," Deboer said.

According to the lawsuit, the lease specifically states the space isn't allowed to be used as a bakery, deli or a place that sells alcohol for off-site consumption, as it would compete with the grocery chain.

"If this hurts them, they were in trouble," Deboer said.

Deboer has questioned square foot specifications mentioned in the lease. 

"In their complaint it says it has to be over 5,000 square feet and we are only 1,650 square feet," Deboer said.

KTVB received a copy of the lease, which outlines the shopping center's restrictions:

"No portion of the Shopping Center other than the Leased Premises shall be used as a supermarket (which shall be defined as any store or department containing at least 5,000 square feet of floor area, including aisle space and storage, primarily devoted to the retail sale of food for off-premises consumption); as a bakery or delicatessen; for the sale of fresh or frozen meat, fish, poultry or produce for off-premises consumption; or for the sale of alcoholic beverages for off-premises consumption." 

The bakery's owner won't be fighting the lawsuit.

"The one lawyer that I talked to said it's a $25,000 to $50,000 lawsuit and at least a $5,000 retainer fee," he said.

The property owner and manager who Deboer signed a lease with, FPA Shoppes at Hillcrest, is also being sued.

"I would have thought they would have told us that's not a use allowed in that space but here we are," Deboer said.

The lawsuit also names Tailgate Growlers, which is right around the corner.

KTVB reached out to Albertsons attorneys but did not get a response.

Albertsons, Safeway recall bakery products over possible Salmonella

Albertsons and Safeway stores in Oregon, Washington and Northern Idaho are voluntarily recalling bakery products supplied by Dawn Food Products made with Valley Milk Product's High Heat Nonfat Dry Milk Powder due to possible Salmonella contamination.

No illnesses have been reported in connection with the bakery products; the recall has been issued out of caution.

The recalled products were sold from the self-service and full-service areas of the bakery on or before December 15, 2016. The products have a Sell By Date of December 20, 2016 (12-20-16) or earlier.

Albertsons baker to get chance on ‘Cake Wars’ TV show

Shannon Scicli, a baker who currently works as a cake decorator at Albertsons on 10th Avenue South, was chosen to compete on the Food Network show “Cake Wars,” which will be filmed later this year.

Shannon Scicli knows how to bake a cake and make it look good, too.

The 28-year-old — who just started working in the bakery at Albertsons grocery store on 10th Avenue South last month — has been invited to participate in the Food Network show “Cake Wars” later this year.

“I watch the Food Network religiously,” Scicli said.

The South Carolina transplant said she has dreams of one day running her own bakery, and perhaps this shot to create cakes with extravagant decorations on national television will help her toward that goal.

“I’m extremely nervous,” she said. “But I’m playing it off like everything is fine.”

Until that happens, though, she’s happy to work alongside four other full-time cake decorators in the bakery department at Albertsons where four of the five are five-star-rated cake decorators, manager Cheryl Larson said.

“It’s been great having Shannon,” Larson said. “She’s a great addition to my team.”

Larson said her staff has 10 years of experience up to 37 years. It takes about three years to get fully trained on creating and decorating cakes with different frostings, fondants and more.

People might think they need to go to a boutique pastry shop to get a fancy cake made with different textures and more. But the five women who bake and decorate cakes at Albertsons stack up with the best.

“If there is a girl here willing to try it, I’m all for it,” Larson said.

Valentine’s Day is their busiest time of the year. This week the crew was preparing to bake and decorate close to 3,200 cupcakes, and every day they are churning out custom orders as well as keeping a case full of cakes ready to go.

Scicli has made all sorts of cake creations since graduating from the Culinary Institute of Charleston and earning her associate degree in business management. She’s worked at a bakery in Charleston, on an Alaskan cruise ship, at Navy and Air Force bases and most recently at the Yellowstone Club in Big Sky.

She made cakes for Ben Affleck and Jennifer Garner as well as Justin Timberlake.

A customer walked up to the bakery counter Tuesday morning at Albertsons, picked out a cake and asked for someone to write a good luck message on the cake. Without breaking a sweat, Scicli squeezed out a frosted message in perfect cursive penmanship atop the cake.

Valentine�s Day specials plentiful in Great Falls

Behind her, Stacy Williams was piping the edges of buttercream-frosted cakes in rapid fire succession.

“All of those take special handling,” Larson said.

Scicli said a passenger aboard the cruise ship she was working on this last summer encouraged her to try out for “Cake Wars.”

As she understands it, she’ll go to Burbank in May. The challenge will be working with a team to create and decorate the best cake. If she succeeds, she’ll get to go on to do more episodes.

“You have a one-in-a-billion shot,” Scicli said.
